Clarification Text Regarding the Law on the Protection of Personal Data

As DUZ Academy Eğitim Danışmanlık ve Organizasyon Tic. Ltd. Şti. (“Company”), we place the utmost importance on the security of your personal data. With this awareness, we highly value the processing and safeguarding of all types of personal data belonging to individuals in relation to the Company, in compliance with the Law on the Protection of Personal Data No. 6698 (“KVKK”). With full awareness of this responsibility, and as a “Data Controller” as defined under the KVKK, we process your personal data as explained below, and within the limits prescribed by the relevant legislation. In this clarification text;

  • Personal Data refers to any information relating to an identified or identifiable natural person,
  • Law on the Protection of Personal Data (“KVKK”) refers to Law No. 6698 on the Protection of Personal Data, which was published in the Official Gazette in April 2016 and came into force,
  • Data Controller refers to the natural or legal person who determines the purposes and means of processing personal data and who is responsible for establishing and managing the data recording system,
  • Data Processor refers to the natural or legal person who processes personal data on behalf of the Data Controller based on the authority given by the Data Controller.

Data Controller: Your personal data, shared with us in your capacity as a counterparty, supplier, customer, employee, intern, visitor, etc., will be evaluated within the scope defined below by the legal entity DUZ Academy Eğitim Danışmanlık ve Organizasyon Tic. Ltd. Şti., which has been designated as the Data Controller.

  1. Collection, Processing, and Purposes of Processing Personal Data:

Your personal data may vary depending on the nature of your relationship with our company and may be collected verbally, in writing, or electronically through automatic or non-automatic methods via our company’s departments, website, social media platforms, mobile applications, and similar channels. Your personal data may be created and processed as long as your relationship with our company continues and may be updated accordingly.
The personal data collected will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK, for the purposes of ensuring the necessary work is carried out by the relevant business units for you to benefit from the services of our company, ensuring the legal and commercial security of our company and the individuals who are in business relations with our company, determining and implementing our company’s commercial and business strategies, and ensuring the execution of our company’s human resources policies. Personal data will be processed in compliance with the following principles:

  • Lawfulness and fairness,
  • Accuracy and, where necessary, keeping up to date,
  • Being processed for specific, explicit, and legitimate purposes,
  • Being relevant, limited, and proportionate to the purposes for which they are processed,
  • Being retained for the period of time stipulated by the relevant legislation or required for the purposes for which they are processed.
  1. To Whom and For What Purposes Processed Personal Data May Be Transferred:

Your collected personal data may be transferred to our business partners, suppliers, legally authorized public institutions, and private persons within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK, for the purposes of ensuring the necessary work is carried out by the relevant business units for you to benefit from the services of our company, ensuring the legal and commercial security of our company and the individuals who are in business relations with our company, determining and implementing our company’s commercial and business strategies, and ensuring the execution of our company’s human resources policies.

  1. Method and Legal Basis for Collecting Personal Data:

Your personal data is collected verbally, in writing, or electronically through various means, including but not limited to the purposes specified above, to provide our services and fulfill our company’s contractual and legal obligations fully and accurately. Your personal data collected for this legal reason may be processed and transferred for the purposes mentioned in Articles (1) and (2) of this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK.

  1. Rights of the Personal Data Owner under Article 11 of the KVKK:

As personal data owners, if you submit your requests regarding your rights to our Company using the methods outlined below, our Company will respond to your request as soon as possible and within no later than 30 days, depending on the nature of the request. However, if a fee is determined by the Personal Data Protection Board, the fee in the tariff set by our Company will be charged. In this context, personal data owners have the right to:

  • Learn whether personal data is being processed,
  • Request information if personal data has been processed,
  • Learn the purpose of processing personal data and whether they are used in accordance with the purpose,
  • Know the third parties to whom personal data is transferred domestically or abroad,
  • Request the correction of personal data if it is incomplete or inaccurately processed,
  • Request the deletion or destruction of personal data within the framework of the conditions set forth in Article 7 of the KVKK,
  • Request notification of the processes carried out in accordance with subparagraphs (e) and (f) to third parties to whom personal data has been transferred,
  • Object to the occurrence of a result against the person by analyzing the processed data exclusively through automated systems,
  • Demand compensation for the damages if they suffer damage due to the unlawful processing of personal data.

Pursuant to Article 13, paragraph 1 of the KVKK, you may submit your request to exercise your rights mentioned above to our Company in writing or through other methods determined by the Personal Data Protection Board. Since the Personal Data Protection Board has not currently determined any methods, your application must be submitted in writing to our Company under the KVKK. In this context, the channels and methods by which you will submit your written application to our Company within the scope of Article 11 of the KVKK are explained below.
To exercise your above-mentioned rights, you must submit your request containing your explanations regarding the right you wish to exercise, clearly and understandably, including documents identifying your identity and address information, by hand, via post, or through a notary to the address info@duzacademy.com.
